Chapter 10 — Mistakes, Risks & Practical Tips
Why You Should Read the Bond Wording Before Submission
Before an issued bond goes to the Obligee, read it against the requirement. A short review catches the details that are easy to correct now and disruptive to correct later.
Direct answer
Read the bond you received and compare it, item by item, with the requirement in your contract or bidding documents. You are checking that the document matches what was asked for.
What to check
- Principal — the exact legal name of the party whose obligation is bonded.
- Obligee — the exact legal name of the party in whose favour it is issued.
- Bond type — the form the requirement calls for.
- Bond amount — the figure, or the basis stated.
- Underlying obligation, project or contract — how the bond identifies what it relates to.
- Relevant dates and validity — start, period and any extension mechanism.
- Other material details — reference numbers, annexes, and any prescribed text.
How to do it well
1. Put the requirement and the issued bond side by side. 2. Work through the list above in order, marking each item. 3. Where a prescribed form was required, compare against that form rather than from memory. 4. Raise any difference before submitting, not after.
What this review is not
A practical read-through is not a substitute for review by the applicable insurer, the Obligee, procurement personnel or legal counsel where that is appropriate. It also does not interpret the bond''s clauses or reach any conclusion about their legal effect — where wording matters, the documents, circumstances and applicable law should be reviewed and professional legal advice may be appropriate.
Why it is worth the time
Corrections made before submission are administrative. The same corrections discovered by the Obligee, on a deadline, are not. See A Final Bond Checklist Before You Submit to the Obligee.
Key considerations
Evaluation, underwriting, documentary requirements, terms, premium, approval and issuance remain functions of the applicable insurer or Surety. The Obligee determines and communicates its applicable bond requirement, subject to governing law and rules where applicable. SuretyPH provides information, accepts inquiries, supports document submission, facilitates applications and communicates status; it does not determine final bond wording, legal sufficiency, acceptance by the Obligee or issuance.
Key takeaway
Compare the issued bond against the requirement item by item — parties, form, amount, obligation, dates and prescribed text — and raise any difference before submitting. This review does not replace insurer, Obligee or legal review.
