How Do Advance Payments Affect Bond Requirements?
Where a construction contract provides for an advance payment, the Obligee may require security connected with that advance. An advance payment bond may support the obligation described in the bond, with the contract and bond wording controlling.
Direct answer
An advance payment is money released under the underlying contract before the corresponding work is performed. Because value passes early, the project owner or Obligee may require security in connection with that advance. An advance payment bond may be one permitted form. The amount, basis, conditions and duration depend entirely on the applicable contract, bond wording, rules and circumstances.
Why an advance changes the picture
When an advance is paid, the Obligee has provided funds ahead of performance. The security it requires is usually connected with the obligation attaching to that advance, as described in the contract. How an advance payment bond generally works
Where the contract requires it and a bond form is permitted, the Principal applies to a Surety. If issued, the bond names the Principal and the Obligee and describes the obligation supported, the amount and the validity.
Contracts commonly describe how the advance is treated over the course of the work, and may describe how the related security is dealt with. Those mechanics are contract-specific. Do not assume a percentage, a schedule, a recovery method or a release trigger; read the actual documents.

- What security, if any, the documents require in connection with it
- Whether a surety bond is a permitted form of that security
- The amount or basis stated in the documents, not an assumed figure

- How the documents describe the treatment of the advance and the related security over time
Important considerations
The bond supports the obligation described in the bond. It does not change the contract's payment arrangements, and it does not make payment under the bond automatic. Depending on the applicable indemnity agreement, bond terms, circumstances and law, the Surety may have rights of recovery against the Principal and/or applicable indemnitors.
The applicable requirement should be confirmed from the current official rules where relevant and from the specific contract or bidding documents. Evaluation, underwriting, requirements, terms, approval and issuance remain with the applicable insurer or Surety.
